Why are These Documents Important?

A last will and testament (will) describes what you want to happen to your assets upon your death and may determine who will take care of minor children.

A durable power of attorney lets you designate a trusted person to handle your financial and property matters if you are not able to do so yourself. This may be due to travel, illness, or injury.

A health care proxy allows you to name a trusted person to make medical decisions for you when you are incapacitated by illness or injury.

Living wills address your preferences for care and treatment in medical emergencies and at the end of your life. It includes instructions for your health care proxy to follow.

Copies of HIPAA authorizations are kept at your doctor’s office. You will want to add your health care proxy to the list of people allowed to access your medical records to make informed decisions.

Burial designations can appoint a person to manage the disposition of your remains and detail your wishes for things like burial or cremation and where and how your funeral service will be handled.

    I did some family planning with your office last year with Diana Lattanzio. Does this asset protection help with any other state other than NY,like Connecticut.

    1. Hi Janice. Asset Protection planning such as the creation of an irrevocable trust starts the 5 year look-back period (in NY) for long-term care Medicaid planning. Every state has its own specific Medicaid laws so if you are permanently relocating out of NYS, then you should seek the advice of counsel admitted to practice law in the new state for an overview of your estate plan and any recommendations on updates or changes.
